On February 11, 2025, the Ministry of Labor, War Invalids and Social Affairs issued Circular No.03/2025/TT-BLDTBXH regulating standards for classifying labor by working conditions.
Accordingly, the subjects of application of the Circular are agencies, organizations and individuals that classify labor by working conditions; employers as prescribed in Clause 5, Article 2 of the Law on Labor Safety and Hygiene. The Circular takes effect from April 1, 2025.
Article 3 of the Circular stipulates the types of working conditions, including 06 types: Type I, Type II, Type III, Type IV, Type V, Type VI; occupations and jobs with working conditions classified as types I, II, III are occupations and jobs that are not arduous, non-toxic, non-dangerous; occupations and jobs with working conditions classified as type IV are occupations and jobs that are arduous, toxic, and dangerous; occupations and jobs with working conditions classified as types V, VI are occupations and jobs that are especially arduous, toxic, and dangerous. Regarding the standards and methods for classifying working conditions, they are stipulated in Article 4 of the Circular.
Employers are responsible for controlling dangerous and harmful factors as prescribed in Chapter II of Decree No. 39/2016/ND-CP dated May 15, 2016 of the Government detailing and guiding the implementation of a number of articles of the Law on Labor Safety and Hygiene; based on the results of monitoring the working environment and the results of preventing dangerous and harmful factors to assess the improvement of working conditions of the applied occupations and jobs; if it is necessary to determine the type of working conditions, follow the method prescribed in Article 4 of this Circular.
Every year, ministries managing sectors and fields shall proactively review the working conditions of occupations and jobs in their sectors and fields; if it is necessary to determine the type of working conditions, it shall be implemented according to the method prescribed in Article 4 of Circular 03/2025/TT-BLDTBXH.
In case of the emergence of new occupations or jobs with arduous, toxic, or dangerous factors, the sector or field management department and the employer shall assess and classify working conditions according to the provisions of Circular 03/2025/TT-BLDTBXH to determine the type of working conditions of that occupation or job.
